This Cancellation & Refund Policy applies to all services provided by Ipware Solutions Intellectual Sdn. Bhd. (“IPWARE”, “we”, “us” or “our”).

By engaging our services and making payment to us, the client acknowledges and agrees to the following terms.

1. Professional Services

IPWARE provides intellectual property and related professional services, which may include trademark searches, consultations, applications, filings, renewals, responses, appeals, assignments, recordals and other related services.

Our services may involve professional time, consultation, document preparation, administrative work, third-party charges and/or official fees.

2. Cancellation

Clients are advised to carefully confirm their instructions, application details and intended services before making payment.

Once we have commenced work on an instruction, the service cannot ordinarily be cancelled and all fees paid are non-refundable.

Where a cancellation request is received before work has commenced, IPWARE may consider the request on a case-by-case basis. Any cancellation or refund in such circumstances shall be subject to our approval.

3. Refund Policy

Unless otherwise expressly agreed by IPWARE in writing, fees paid for services that have commenced are non-refundable.

No refund will be provided merely because a client subsequently decides not to proceed, changes their business plans, changes a brand or trademark, or no longer requires the service after work has commenced.

Where an application, submission or other transaction has already been filed, or where official fees, third-party fees or other charges have been incurred, such amounts are non-refundable.

4. Application Outcomes

IPWARE does not guarantee the registration, acceptance or successful outcome of any trademark, intellectual property application or related matter.

Applications and proceedings may be subject to examination, objections, requirements, opposition, refusal, delay or other decisions by the relevant Registrar, authority or third party.

Accordingly, an objection, refusal, opposition, delay or unsuccessful outcome does not constitute grounds for cancellation or refund of professional fees, official fees or other charges already incurred.

Where further work is required following an objection, opposition or other issue, additional professional fees and/or official fees may apply unless such work is expressly included in the service or package purchased.

5. Payment by Instalment, Card or Third-Party Payment Provider

Where payment is made using a credit or debit card, payment link, instalment arrangement, Buy Now Pay Later (“BNPL”) service or other third-party payment provider, this Cancellation & Refund Policy shall continue to apply.

Using a third-party payment provider does not alter the terms of the service or automatically create a right to cancellation or refund.

Any approved refund, where applicable, may also be subject to the procedures and processing times of the relevant payment provider or financial institution.

6. Duplicate or Incorrect Payments

If a client believes that a duplicate payment or incorrect payment has been made, the client should contact us as soon as reasonably possible.

Upon verification, IPWARE may refund any confirmed excess or duplicate payment.

7. Exceptional Circumstances

Notwithstanding the above, IPWARE may consider a refund or partial refund in exceptional circumstances at its discretion, including where we are unable to provide the agreed service.

Any refund approved by IPWARE will be assessed based on the circumstances of the matter, including work already performed and any official fees, third-party charges or other costs already incurred.

Nothing in this policy is intended to exclude or restrict any rights or remedies that cannot lawfully be excluded under applicable Malaysian law.
